Boot Camp Web Terms and Conditions
The following are the Terms & Conditions that must be agreed upon in order to open an account with Boot Camp Web.
All users of our service will be bound to this agreement.
Refusal of Service
We reserve the right to refuse, cancel, or suspend service to anyone for any reason at our sole discretion.
Domain Names
Domain Names registered through Boot Camp Web must follow the Uniform Domain Name Dispute Resolution Policy as approved by ICANN.
Passwords - Account Ownership
The Account Holder, as defined by the party listed in the Boot Camp Web accounting system submitted by the customer upon initial registration, shall be responsible for maintaining security of its username and password. Boot Camp Web will not change passwords to any account without proof of identification, which is satisfactory to Boot Camp Web, which may include written authorization with signature. In the event of any dissolution of a corporation or partnership, divorce or other legal action that includes Account Holder, Account Holder understands that Boot Camp Web will remain neutral and may put the account on hold until final adjudication of the disposition of the domain name by a court with appropriate jurisdiction. Under no circumstances will Boot Camp Web be liable for any losses incurred by Account Holder during this time of determination of ownership, or otherwise. The Account Holder agrees to indemnify and hold harmless Boot Camp Web from any and all Claims arising from such ownership disputes. In the event of a breach of security through the Account Holder's account, the Account Holder will be liable for any unauthorized use of the Boot Camp Web services, including any damages resulting thereof, until the Account Holder notifies Boot Camp Web’s Customer Service Department.
Unacceptable Content
All services provided by Boot Camp Web may be used for lawful purposes only. Further, all users agree to use Boot Camp Web ONLY in the promotion and operation of their Adventure Boot Camp business and affiliated services (such as Personal Training). Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene and material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Adventure Boot Camp, Inc., Boot Camp Web, Koenig Creative, it’s affiliates and its employees from any claims resulting from the use of the service which damages the subscriber or any other party. Boot Camp Web will be the sole arbiter as to what constitutes a violation of this provision. Also prohibited are sites that promote any illegal activity or present content that may be damaging to Boot Camp Web’s affiliate servers or any other server on the Internet. Links to such materials is also prohibited.
Use of Media
Media provided by Boot Camp Web is intended for lawful purposes only. Purchasers are prohibited from using them in a way, which we judge to be threatening or obscene. Account Holders are not allowed to in any way make media available for download or distribution, or give permission to download or save images from their site.
Account Holder also agrees to limit the file and streaming size of media within an acceptable range of bandwidth transmission, which is based upon what Boot Camp Web determines acceptable at any given time. Boot Camp Web reserves the sole right to review Account Holder-posted media, recommend alternatives to that media if it is too large for our server bandwidth to handle and remove said media if Account Holder does not comply with Boot Camp Web’s recommendations. Media types that fall under this categorization are typically large FLASH or video-based files.
System and Network Abuse
Any attempt to undermine, compromise the security of or otherwise cause harm to any Adventure Boot Camp, Inc., Boot Camp Web, Koenig Creative or their affiliate’s equipment or customer accounts is strictly prohibited and will result in the cancellation of the account and possible legal action for any disruption to service or damages to Boot Camp Web's network, web sites and its affiliates' network configurations or equipment.
Web Site Files
Although Boot Camp Web does perform daily backups, Account Holder does not hold Boot Camp Web liable for any loss of data either on Account Holder or Boot Camp Web's part. There will be a $50 restore fee should Boot Camp Web be required to provide a web site restore per Account Holder’s request if any data loss os caused due to Account Holder's actions. Boot Camp Web has the right to delete all data, files, or other information in the customers web site account without providing backup copies to the Account Holder if either Boot Camp Web or the Account Holder terminates the customer's account with Boot Camp Web for any reason.
Further, Account Holder understands that should Account Holder cancel their account at any time for any reason, or if Boot Camp Web and its affiliates cancel an Account Holder's account at any time for any reason, or if Boot Camp Web cancels overall services at any time for any reason, their web site files and content are not transferable and cannot be hosted or modified by any other agency and will not be relinquished to Account Holder's ownership by Boot Camp Web or its affiliates. As the ABC Titanium Web Site Solution is a database-driven application, Titanium Web Sites may only be developed and utilized as a part of our overall service and it is understood by account holder that their non-refundable $899 setup fee is a licensing fee and not the cost to purchase a physical web site that may be hosted or modified outside of the ABC Titanium Web Site solution application’s unique framework.
Mass Email Service
As a complementary service to Account Holder, Boot Camp Web offers the ability to send email to an individual or list of campers or trainers directly from their Titanium web site. This service is intended for the delivery of specific camp information to campers and trainers and is not intended to take the place of a mass email marketing campaign service such as Constant Contact.
Limit on Number of Emails: Account Holder agrees to send a total of NO MORE THAN 6 emails per month, per camp, per location, or to a total of 500 total recipients, whichever is less. Boot Camp Web will monitor all email activity on a monthly basis and notify Account Holder once they have reached or exceeded their monthly limit. Should the Account Holder exceed their monthly limit after two notifications, Boot Camp Web reserves the right to deactivate Account Holder’s mass email service or deactivate the Account Holder’s Boot Camp Web Site account altogether without notice to Account Holder if it deems necessary to ensure the continuation of service for its other Account Holders and retain its good standing with its technology, search engine and hosting providers and services.
Limit on Email Recipient Types: Account Holder agrees to ONLY send mass email out to its current customers and trainers and who have opted-in for email receipt by registering for a camp or becoming an employee of the Account Holder’s business. Account Holder agrees NOT to send out emails to friends, associates, vendors, past or prospective customers using Titanium’s Mass Email Service for any reason at any time. Boot Camp Web reserves the right to deactivate Account Holder’s mass email service or deactivate the Account Holder’s Boot Camp Web Site account altogether without notice to Account Holder if it deems necessary to ensure the continuation of service for its other Account Holders and retain its good standing with its technology, search engine and hosting providers and services.
No Database Upload: Account Holder agrees NOT to upload or request that a database Email list be uploaded to their Boot Camp Web account at any time for any reason. Individual and Mass Email may ONLY be sent to current customers and trainers. Boot Camp Web reserves the right to deactivate Account Holder’s mass email service or deactivate the Account Holder’s Boot Camp Web Site account altogether without notice to Account Holder if it deems necessary to ensure the continuation of service for its other Account Holders and retain its good standing with its technology, search engine and hosting providers and services.
Anti-SPAM & Limited Use Policy: Account Holder agrees NOT to use Boot Camp Web’s Mass Email Service for any other purpose than providing updates to its current campers and trainers. Should Account Holder use the Mass Email Service for ANY reason other than the above stated, Boot Camp Web reserves the right to deactivate Account Holder’s Boot Camp Web Site account altogether without notice to Account Holder if it deems necessary to ensure the continuation of service for its other Account Holders and retain its good standing with its technology, search engine and hosting providers and services.
Limited Liability
Use of Boot Camp Web’s services is at the customer’s sole risk. Neither Boot Camp Web, its employees, affiliates, third party services, merchant licensors or the like, warrant that Boot Camp Web web hosting service will not be interrupted or error free. Boot Camp Web will make every good faith effort to ensure that its web servers are available to as many Internet users as possible and that there is minimal interruption of service as possible. In no circumstance will Boot Camp Web, its employees, or its affiliates be liable for any claims, any action either direct, indirect, special, incidental, or consequential, or any damages either punitive or alleged to have resulted, including loss of profits, from the use of or inability to use Boot Camp Web services, from service interruptions, from customer errors or problems with their Internet connectivity, from unauthorized access to Boot Camp Web hosting services, from communication failure, from bandwidth congestion or interruptions, from delays in service or from acts of God.
Boot Camp Web Pricing
Boot Camp Web reserves to right to increase or decrease it’s pricing at anytime, for any reason. This includes both setup and monthly fees. Account Holders will receive at least two month’s notification from Boot Camp Web when a change in pricing will occur and will be given the option to cancel or continue their service.
Account Activation
By activating your account with Boot Camp Web, you agree to the above policies and disclaimer. Upon requesting account activation, you are required to accept these policies, guidelines and disclaimer in their entirety and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.
